What is THCA?
THCA stands for tetrahydrocannabinolic acid — the raw, non-psychoactive precursor to THC. It is found naturally in all living cannabis plants.
The Science
- •THCA converts to THC through decarboxylation — the application of heat (smoking, vaping, cooking).
- •In its raw form, THCA is non-intoxicating. You cannot get high from eating raw cannabis flower.
- •Every cannabis plant on Earth produces THCA. It is the natural biosynthetic pathway of the plant.
Why This Matters Legally
Under HB 1325, hemp is legal in Texas if its Delta-9 THC concentration is under 0.3% by dry weight. THCA is NOT Delta-9 THC— they are chemically distinct molecules. The Texas “Total THC” rule conflates them by using the formula: Total THC = 0.877 × THCA + Delta-9 THC. The Legislature never voted on this formula.
HB 1325 Explained
House Bill 1325 is the law that legalized hemp in Texas. Here is what it says and what DSHS is trying to change.
HB 1325 passed by the Texas Legislature and signed into law. Legalized hemp containing less than 0.3% Delta-9 THC by dry weight.
Created DSHS licensing for hemp retailers and manufacturers. Reggie & Dro now operates under an Oregon Hemp Handler license for interstate commerce.
The Legislature REJECTED SB 3, SB 5, and SB 6 — bills that would have redefined THC to include THCA. The democratic process spoke.
DSHS adopted new rules REDEFINING "THC" to include THCA via the Total THC formula — doing what the Legislature explicitly refused to do.
Texas Agriculture Code §122.001(1)
“Hemp” means the plant Cannabis sativa L. ... with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.
The statute says “delta-9 tetrahydrocannabinol” — not “total THC.”
Know Your Rights

Possession Remains Legal
Possession of hemp products remains LEGAL in Texas even after March 31, 2026. The DSHS rules target the sale of smokable hemp — not possession by consumers.
Only Sale of Smokable Hemp Is Banned
The March 31 rules ban the SALE of smokable hemp products in Texas. Delta-9 edibles, tinctures, topicals, and CBD products remain fully legal to sell and purchase.
Interstate Shipping Is Protected
You can still RECEIVE hemp products shipped from legal states. The 2018 Farm Bill protects interstate commerce of hemp products that comply with federal standards.
Oregon Hemp Handler Licensed

Right to Lab Results
You have the right to access a Certificate of Analysis (COA) for any hemp product you purchase. If a retailer cannot provide one, do not buy from them.

Key distinction:The Farm Bill uses only Delta-9 THC concentration to define hemp. The “Total THC” formula (0.877 × THCA + Delta-9) is a state-level invention by DSHS, not a federal standard.
How to Read a COA
A COA (Certificate of Analysis) is your proof that a hemp product is safe, legal, and accurately labeled. Every R&D product comes with one.
What to Look For
Must be below 0.3% by dry weight to qualify as legal hemp under HB 1325 and the 2018 Farm Bill.
Tetrahydrocannabinolic acid. The raw precursor to THC. Present in all cannabis plants. NOT the same as Delta-9 THC.
Primary therapeutic cannabinoids. Higher CBD/CBG ratios indicate wellness-focused products.
Aromatic compounds that influence flavor and effects. Look for myrcene, limonene, linalool, and caryophyllene.
Tests for residual pesticides. Clean products show ND (Not Detected) across all analytes.
Tests for lead, arsenic, cadmium, and mercury. Cannabis plants are bioaccumulators — this panel is critical.
Tests for mold, yeast, E. coli, and salmonella. Especially important for flower and concentrates.
Tests for leftover extraction chemicals (butane, ethanol, CO2). Applies to concentrates and extracts.
